Welcome to drip image. These Terms of Service ("Terms") govern your access to and use of our image transformation API service ("Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

drip image provides an image transformation API that allows you to:

• Resize, crop, and format images via URL parameters
• Apply AI-powered transformations including background removal and upscaling
• Connect your own cloud storage for image sources
• Access transformed images through a global CDN

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

• Process, store, or transmit illegal, harmful, or objectionable content
• Infringe on the intellectual property rights of others
• Process images containing child exploitation material (zero tolerance)
• Distribute malware or engage in phishing
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Circumvent usage limits or billing mechanisms
• Resell or redistribute the Service without authorization
• Use the Service for any unlawful purpose

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

5. Credits and Billing

5.1 Credit System

The Service operates on a credit-based system:

• Basic transforms (resize, crop, format) consume 0.1 credits per operation
• AI transforms (background removal, upscaling) consume 1 credit per operation
• Credit costs may vary and will be displayed in your dashboard
• Credits do not expire while your account remains active

5.2 Payment Terms

• All fees are non-refundable unless otherwise stated
• You are responsible for all applicable taxes
• We may change pricing with 30 days notice
• Failed payments may result in service suspension

5.3 Free Tier

Free accounts receive a limited number of credits. Free tier availability and limits may change at our discretion.

6. Intellectual Property

6.1 Your Content

You retain all rights to images you process through our Service. By using the Service, you grant us a limited license to process, transform, and cache your images solely to provide the Service.

6.2 Our Property

The Service, including all software, APIs, documentation, and branding, is owned by drip image and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Service.

7. Data and Privacy

Your use of the Service is subject to our Privacy Policy. Key points:

• We process images only as necessary to provide the Service
• Transformed images may be cached temporarily to improve performance
• We do not use your images for training AI models without consent
• Source bucket credentials are encrypted and stored securely

8. Service Level and Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with reasonable notice
• Experience downtime due to circumstances beyond our control
• Modify, suspend, or discontinue features with notice

Enterprise customers may be eligible for SLA agreements with specific uptime guarantees.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM

10. Indemnification

You agree to indemnify and hold harmless drip image, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you process through the Service

11. Termination

Either party may terminate this agreement at any time:

• By You: Cancel your account through the dashboard or by contacting support
• By Us: Suspend or terminate accounts that violate these Terms or for any reason with 30 days notice

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Sending an email to your registered address
• Displaying a notice in your dashboard

Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and drip image
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Failure to enforce any provision does not constitute a waiver
• Assignment: You may not assign these Terms without our consent
